TERMS AND CONDITIONS OF SALE

Last Updated: July 9, 2026

Welcome to Anderson Armory (“Company,” “we,” “us,” or “our”). By accessing our website, creating an account, or purchasing any products, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. Federal Firearms License (FFL) Shipping Requirement

  • No Direct Shipping: In compliance with federal law, we do not ship firearms or regulated items directly to individuals.
  • FFL/SOT Transfer: All firearms and National Firearms Act (NFA) regulated items ordered online must be shipped to a third-party Federal Firearms License (FFL) holder (and Special Occupant Taxpayer [SOT] holder for suppressors) chosen by the buyer.
  • Buyer Responsibility: It is the buyer's responsibility to contact their chosen dealer, confirm they accept the transfer, and arrange for a copy of their license to be sent to us.
  • Transfer Fees: Any transaction or transfer fees charged by your local dealer are strictly between you and that dealer.

2. Legal Age and Eligibility Representations

  • Age Requirements: By placing an order, you represent that you are at least 21 years of age to purchase handguns, receivers, or suppressors, and at least 18 years of age for long guns.
  • Background Check: All firearms sales are strictly contingent upon the buyer passing a mandatory NICS background check at the destination FFL.
  • Lawful Use: You certify that you are a legal resident of the United States, are not a prohibited person under 18 U.S.C. § 922(g), and will use the product in a lawful manner.

3. Special Provisions for NFA Items (Suppressors)

  • ATF Approval Required: The purchase and transfer of a suppressor require compliance with the National Firearms Act (NFA) and approval from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
  • Lengthy Wait Times: Buyers acknowledge that ATF Form 4 processing times vary and are completely outside the control of Anderson Armory. Orders cannot be cancelled or refunded while an ATF Form 4 application is pending.
  • Ownership Restrictions: Ensure that suppressors are legal to own in your state and municipality before purchasing.

4. Background Check Failures, NFA Denials, and Cancellations

  • Standard Failed Background Checks: If you fail your background check or are unable to complete the transfer for a standard firearm, you will receive a refund for the product minus a 35% restocking fee and all incurred shipping and handling costs.
  • Denied NFA/Suppressor Applications: If your ATF Form 4 application is denied for any reason, or if you fail to complete the required NFA paperwork, you will receive a refund minus a 50% restocking fee and all shipping costs.
  • Non-Refundable Fees: Any local background check, FFL handling fees, or ATF tax stamp fees ($200) are entirely non-refundable.
  • Abandoned Orders: Orders that remain at the destination FFL uncollected or without paperwork initiated for more than 30 days will be treated as cancelled and subject to the respective restocking fees.

5. Website Errors and Pricing Policy

  • Right to Cancel: In the event a product is listed at an incorrect price or with incorrect information due to a typographical error or an error in pricing or product information received from our suppliers, Anderson Armory reserves the right to refuse or cancel any orders placed for that product.
  • Order Rejection: We reserve this right regardless of whether the order has been confirmed and your credit card charged.
  • Refund Issuance: If your credit card has already been charged for the purchase and your order is cancelled due to a typographical error, Anderson Armory will immediately issue a credit to your credit card account in the amount of the incorrect price.

6. Geographic Sales Restrictions

  • Compliance with Local Law: It is your sole responsibility to ensure that the firearm, suppressor, or accessory is legal to own in your specific state, county, and city.
  • Prohibited Jurisdictions: We do not ship specific restricted items (e.g., suppressors, high-capacity magazines) to jurisdictions where they are legally banned.
  • No Online Ammunition Sales: Anderson Armory does not sell or ship ammunition online. Any ammunition inventory is restricted exclusively to in-store purchases.
  • International Orders: We strictly engage in domestic commerce within the United States. We do not ship internationally.

7. Return and Warranty Policy

  • Final Sales: All firearms and suppressor sales are considered final once the transfer is completed at your local dealer. Inspect your items thoroughly at the dealer before signing the final transfer paperwork.
  • Pre-Transfer Returns: If a defect is found prior to completing the transfer, contact us immediately to arrange a return.
  • Warranty Claims: Deficiencies discovered after the transfer must be handled directly through the original manufacturer’s warranty program. Anderson Armory excludes any implied warranties to the fullest extent permitted by law.

8. Limitation of Liability and Indemnification

  • Assumption of Risk: The buyer assumes all risk associated with the handling, storage, transportation, use, or misuse of any items purchased, specifically including NFA regulated devices.
  • Liability Cap: To the maximum extent allowed by law, Anderson Armory shall not be liable for any punitive, incidental, or consequential damages. Our maximum aggregate liability is limited strictly to the dollar amount paid for the specific product.
  • Indemnification: You agree to indemnify and hold harmless Anderson Armory from any claims, damages, or legal expenses arising from your unlawful use, improper handling, or negligent storage of products purchased from this site.

9. Governing Law and Dispute Resolution

  • Jurisdiction: These terms are governed by and construed in accordance with the laws of the State of New Hampshire, without regard to conflict of law principles.
  • Mandatory Arbitration: Any dispute arising out of your purchase shall be resolved through binding, individual arbitration in Hudson, New Hampshire, and you explicitly waive your right to participate in a class-action lawsuit.
